Nothing in this procedure shall limit the authority of school officials to search a student in accordance with policy 7:140, Search and Seizure. All property removed as a result of this procedure that may be legitimately brought onto District property will be returned to the individual.  Property removed from a student, possession of which violates Board policy, shall be confiscated and the student disciplined in accordance with Board policy.

Students who fail to cooperate with school personnel performing their duties may be subject to discipline for insubordination and/or removal from school property.

Metal Detector Checks of All/Groups of Students (Random Searches)

1.       The Superintendent or designee may decide to conduct a metal detector check on all students entering a school, or he or she may select a group of students to be checked at random on a neutral, nondiscriminatory basis. The group selected for a random check may be a classroom(s), a bus(ses), or any other group of students determined by the Superintendent or designee in accordance with these procedures.

2.       The participating administrator, security personnel, or law enforcement officer will explain the scanning process to students, emphasizing that the checks are intended to maintain safe schools. 

3.       An administrator, security personnel, or law enforcement officer will direct students with their personal effects into a designated area to proceed with the metal detector check. An administrator, security personnel, or law enforcement officer will closely observe students to make sure no objects are removed from pockets or personal effects. 

4.       The administrator, security personnel, or law enforcement officer will ask the student to remove all metal-containing objects from his or her clothing and personal effects. The administrator, security personnel, or officer will then direct the student to undergo the metal detection. If the student refuses to cooperate, the supervisor shall not permit the student to enter the school building. 

5.       If the metal detector alerts during the scanning of the student's effects, the administrator, security personnel, or law enforcement officer will ask the student to open the bag, purse, etc. and the person conducting the search will proceed to look for weapons. 
If the metal detector alerts during the scanning of the student's person, the student will be given a second opportunity to remove any metal­ containing object from his or her person. A second scan will be conducted and if the metal detector alerts again, but no administrator is present, the student will be held until an administrator is present. 
The student will be interviewed to determine the source of the alert and given the opportunity to remove any metal-containing objects a third time. If the metal detector alerts again, the administrator shall contact the student’s parent or guardian and will not be permitted to enter the school building until the administrator has confirmed that the student is not in possession of a weapon.
 
Metal Detector Checks of An Individual Student (Reasonable Suspicion)
Except as described above, before conducting a metal detector check of an individual student, the administrator, security personnel, or officer must have individualized reasonable suspicion that the student is in possession of an illegal or unauthorized metal-containing object or weapon. The relevant provisions of the above procedure shall be followed for the individual student once identified for a check based on reasonable suspicion.

When there is reasonable suspicion a student is in possession of a weapon and the search has not produced the item, a School Resource Office or other law enforcement personnel may be asked to conduct a search.  

Students who do not cooperate with this process are subject to school disciplinary actions.  

Pat-Down Search

When feasible, a pat-down search should be conducted: (1) outside the view of others, including students; (2) in the presence of a school administrator or adult witness; and (3) by a certificated employee or liaison police officer of the same sex as the student.

A pat-down search conducted by school personnel shall be limited to clothing for the purpose of discovering items that may have activated the metal detecting device. If school personnel conducting a pat-down search feel an object that may have activated the metal detecting device or may be other prohibited contraband, the individual will be asked to remove it.

Immediately following a pat-down search, a written report shall be made by the school authority who conducted the pat-down search, and given to the Superintendent.

Nada en este procedimiento limitará la autoridad de los funcionarios escolares para registrar a un estudiante de acuerdo con la política 7:140, Registro e incautación. Toda la propiedad removida como resultado de este procedimiento que pueda ser traída legítimamente a la propiedad del Distrito será devuelta al individuo. La propiedad retirada de un estudiante, cuya posesión viola la política de la Junta, será confiscada y el estudiante disciplinado de acuerdo con la política de la Junta.

Los estudiantes que no cooperen con el personal de la escuela en el desempeño de sus funciones pueden estar sujetos a medidas disciplinarias por insubordinación y/o remoción de la propiedad escolar.

Verificaciones de Detectores de Metales de todos/grupos de Estudiantes (búsquedas aleatorias)

1. El Superintendente o la persona designada puede decidir realizar una verificación con detector de metales a todos los estudiantes que ingresan a la escuela, o puede seleccionar un grupo de estudiantes para que sean revisados al azar sobre una base neutral y no discriminatoria. El grupo seleccionado para una verificación aleatoria puede ser un salón de clases, un autobús o cualquier otro grupo de estudiantes determinado por el Superintendente o su designado de acuerdo con estos procedimientos.

2. El administrador participante, el personal de seguridad o el oficial de la ley explicará el proceso de escaneo a los estudiantes, enfatizando que los controles están destinados a mantener las escuelas seguras.

3. Un administrador, personal de seguridad o agente de la ley dirigirá a los estudiantes con sus efectos personales a un área designada para proceder con la verificación del detector de metales. Un administrador, personal de seguridad o agente de la ley observará de cerca a los estudiantes para asegurarse de que no se saquen objetos de los bolsillos o efectos personales.

4. El administrador, el personal de seguridad o el oficial de la ley le pedirán al estudiante que se quite todos los objetos que contengan metal de su ropa y efectos personales. El administrador, el personal de seguridad o el oficial ordenarán al estudiante que se someta a la detección de metales. Si el estudiante se niega a cooperar, el supervisor no permitirá que el estudiante ingrese al edificio de la escuela.

5. Si el detector de metales alerta durante el escaneo de los efectos del estudiante, el administrador, el personal de seguridad o el oficial de la ley le pedirán al estudiante que abra el bolso, cartera, etc. y la persona que realiza la búsqueda procederá a buscar armas. .

Si el detector de metales alerta durante el escaneo de la persona del estudiante, se le dará al estudiante una segunda oportunidad para quitar cualquier objeto que contenga metal de su persona. Se realizará un segundo escaneo y si el detector de metales alerta nuevamente, pero no hay un administrador presente, el estudiante será retenido hasta que esté presente un administrador.

Se entrevistará al estudiante para determinar la fuente de la alerta y se le dará la oportunidad de retirar cualquier objeto que contenga metal por tercera vez. Si el detector de metales vuelve a alertar, el administrador se comunicará con el padre o tutor del estudiante y no se le permitirá ingresar al edificio de la escuela hasta que el administrador haya confirmado que el estudiante no está en posesión de un arma.

 

Controles del Detector de Metales de un Estudiante Individual (sospecha razonable)

Excepto como se describe anteriormente, antes de realizar una verificación del detector de metales de un estudiante individual, el administrador, el personal de seguridad o el oficial deben tener una sospecha razonable individualizada de que el estudiante está en posesión de un objeto o arma que contiene metal ilegal o no autorizado. Las disposiciones pertinentes del procedimiento anterior se seguirán para el estudiante individual una vez identificado para un control basado en una sospecha razonable.

Cuando existe una sospecha razonable de que un estudiante está en posesión de un arma y la búsqueda no ha producido el artículo, se le puede pedir a la Oficina de Recursos Escolares u otro personal policial que realice una búsqueda.

Los estudiantes que no cooperen con este proceso están sujetos a acciones disciplinarias escolares.

Búsqueda Cacheada

Cuando sea factible, se debe realizar un cacheo: (1) fuera de la vista de los demás, incluidos los estudiantes; (2) en presencia de un administrador escolar o testigo adulto; y (3) por un empleado certificado o policía de enlace del mismo sexo que el estudiante.

Una búsqueda de cacheo realizada por el personal de la escuela se limitará a la ropa con el fin de descubrir elementos que puedan haber activado el dispositivo de detección de metales. Si el personal de la escuela que lleva a cabo una revisión palpa un objeto que puede haber activado el dispositivo de detección de metales o puede ser otro contrabando prohibido, se le pedirá a la persona que lo retire.

Inmediatamente después de un cacheo, la autoridad escolar que realizó el cacheo deberá hacer un informe escrito y entregarlo al Superintendente.
