3Formal ComplaintIf Formal Complaint is Filed, consider whether Complaint should be dismissed for procedural or jurisdictional issues

4Emergency RemovalConsider Emergency Removal of Respondent
- Coordinator must make a preliminary determination whether it is appropriate to remove Respondent from school (immediate threat)

5NoticeProvide Notice to Parties of Title IX Grievance Process

6Informal ResolutionOffer Informal Resolution and Optional: Conduct Informal Resolution
- Written consent of both Parties is required before conducting informal resolution

7InvestigationConduct Investigation & Gather Evidence
- Collect testimony, documents, and tangible objects
- Both Parties have access to all evidence, including evidence the District does not intend to rely on

8EvidenceProvide Parties with Evidence:
- Prior to close of investigation, investigator should provide both Parties with any "directly related" evidence so that each party can meaningfully respond before report is finalized
- Provide both parties at least 10 school business day to submit written response

9ReportInvestigatory Report is Finalized
- Once all interviews and evidence submissions are completed, investigator must create an investigative report that summarizes relevant evidence
- The report must be sent to the Parties and advisors electronically. Parties have at least 10 school business days to submit written responses to Initial Decision Maker.

10Initial Decision MakerTransition to Initial Decision Maker: Once investigator report is prepared, the following is transmitted to the Initial Decision Maker:
- Formal Compliant
- All evidence gathered that is directly related to the allegations (even if discounted/dismissed)
- Investigative Report

11Follow UpMandatory Questions to Initial Decision Maker & Follow-Up Questions
- Provide both Parties opportunity to submit written questions asked of any party/witness
- 5 school business days to submit questions
- Allow limited, follow-up questions within 5 days of notice

12Written Decision and Appeal
- After questions, Initial Decision Maker provides decision to both Parties simultaneously
- Provide 10 school business days after receiving dismissal/decision for Parties to submit written request for appeal
- Parties have 5 school business days to submit a written statement in support of, or opposition to, the appeal
- Appellate Decision Maker has 30 days to decide
