      Formal Complaint

      Act of Title IX Sexual Harassment Occurs or Formal Complaint is filed

      Intake Meeting is Held

      • Title IX Coordinator Must:
      • Discuss the availability of supportive measures with the alleged victim, while considering his/her wishes
      • Explain the process for filing a Formal Complaint

      After Report is Filed

      Supportive Measures Include:
      • Counseling, social worker visits
      • Deadline extensions
      • Schedule, class, transportation modifications
      • Regular check-ins; escorts
      • Increased security/monitoring
      • Mutual contact restricts

      Note:  Any supported measures implemented must be kept as confidential as possible.

      Once a Report is Filed

      Preliminary Considerations Include:
      • If the allegations: (1) do not meet the definition of "sexual harassment" or (2) is not within the "educational program," or (3) did not occur within the United States, the Formal Complaint must be dismissed. • The Coordinator may dismiss if: (1) Respondent is no longer enrolled/employed; (2) Complainant requests withdrawal; or (3) Absence of sufficient evidence.

      Consider Emergency Removal of Respondent

      • The Title IX Coordinator must make a preliminary determination whether it is appropriate to make an immediate removal of the Respondent from the school.
      • If the respondent is a student, first consider whether the Respondent presents an immediate threat to the health of safety of the Complainant or other student. If so, consider alternative placements or suspension.
      • If the respondent is an employee, consider administrative leave.

      Notice

      Send Notice to Both Parties of Formal Title IX Complain of Sexual Harassment

      Offer Informal Resolution

      • District are permitted to offer an facilitate informal resolution options (mediation or restorative justice)
      • Both parties must provide voluntary, informed and written consent
      • A Formal Complaint must be filed before proceeding to informal resolution.
      • Informal Resolution is allowed at any point during the grievance process, and Parties may withdraw at any time before an agreement is reached.
