CONDITIONAL PROBATION CONTRACT

And

    THIS AGREEMENT is entered into by and between Community Unit School District #100, Boone, DeKalb and McHenry Counties, Illinois (hereinafter referred to as “District”),     (Student)       (hereinafter referred to as “Student”) and Mr. and Mrs.      (Parent(s)/Guardian(s)) (hereinafter referred to collectively as “Parent”) with regard to the following:

On    (Date of Incident/Suspension)     Student received a 10-day suspension and recommendation for expulsion from       (School)       for        (Offense)            on District property.  Student, his parents, and District administrators met on ___(Date of Pre-Expulsion Meeting)   and discussed the District’s expulsion process and all options.  Student admitted that _(he/she)   committed the allege offense by       (facts supporting the offense)  .  As a result of that meeting, Student, Parent and the District agree as follows:

1.  Student shall serve the entire 10-day suspension.

2.  During the time of the suspension, Student shall not be allowed on District property or attend any District functions without prior written authorization from the Superintendent of Schools.  

3.  Neither Student nor Parent shall attempt to enroll Student in another District.

4.  At the conclusion of the suspension, Student may return to     (School)          under the following conditions:

a.  *(Only applies to alcohol or drug offenses) Student shall have completed an alcohol and drug assessment by a company that has been properly licensed by the Illinois Department of Human Services to perform such assessments before Student is allowed to return to school.  Student and/or parents shall provide proof of the assessment to Principal                                        before Student is allowed to return to school.  Student shall immediately enroll in the recommended counseling, which shall be at a minimum the DAFA program, and shall diligently attend and complete the recommended counseling.  Student and Parents shall sign a release with the assessor and provider of treatment allowing Principal _________________ to discuss the assessment and counseling with the provider.  Parents shall provide timely written proof of enrollment and completion of the counseling to Principal _____________. 

b.  Student shall attend school on a regular basis, without any truancies and/or unexcused absences. 

c.  Student will not further violate school or district rules.

d.  Student will work toward and demonstrate academic success, including attending and participating in all academic classes.

1.  District shall hold in abeyance any current proceedings for an expulsion of Student pending his abiding by the terms of this Agreement.

2.  In the event Student or Parent violates the conditions of this Agreement, Student and Parent expressly agree that the District may proceed with the expulsion proceeding before the Board of Education.

3.  This agreement is in effect for the remainder of the time that Student is eligible to attend District schools.

Student and Parent hereby acknowledge they have had an opportunity to consider the terms of this Agreement and have had the opportunity to review it with a representative of their choice.  In addition, Student and Parent agree that the District shall have no obligation to provide educational services to Student during the period of suspension.  Further, and in consideration of the District’s agreement to hold the expulsion, Student and Parent hereby waive and release the District, its officers, employees and agents from any liability or claims of any kind, whether arising under State or Federal law, in connection with the events resulting in the Administration’s recommendation for expulsion and the resulting Agreement.
